Is It Legal to Download Douyin Videos?

By the Calculator.hair team · Updated · 6 min read

Short answer

There's no single yes or no. It depends on where you live, who owns the video and what you do with the file. Downloading your own video, or one you have permission to use, carries the least risk. Reposting or using someone else's clip commercially without permission carries far more. Douyin's terms can also restrict copying, separately from copyright law.

Key takeaways

  • A video being publicly viewable doesn't mean you're free to copy or reuse it.
  • Copyright law and Douyin's user agreement are separate, so you need to consider both.
  • Saving a clip privately and reposting it publicly are very different situations.
  • Fair use is a US legal concept decided case by case, so it isn't a guarantee or a universal rule.
  • Having a downloaded file doesn't give you the right to repost it, even if you credit the creator.

This guide is general education, not legal advice. Copyright law varies by country, so speak to a qualified lawyer if a specific use matters to you.

Who owns a Douyin video?

Usually, the creator or another original rights holder does, not the person who saved a copy. In Douyin's user agreement, users state that what they post is original or properly licensed, and that the rights in their uploads belong to them or to the original rights holder.

One clip can also involve more than one owner. A creator may hold the rights in their footage while a record label or music publisher holds rights in the song playing over it. This is why a creator's permission may not cover the music, and why extracting a song as audio raises its own questions.

What does Douyin's user agreement say?

We looked at the Chinese-language Douyin User Service Agreement. This is our plain-English summary of what we found, not an official translation:

  • Users get a personal, revocable, non-transferable, non-exclusive and non-commercial license.
  • Copying, adapting, distributing, scraping or mirroring without the company's prior written permission isn't allowed (clause 2.4).
  • Obtaining, copying or downloading Douyin content by improper means, including hotlinking, scraping and "simulated download" (模拟下载), isn't allowed (clause 5.3).
  • Using plugins or third-party tools that interfere with the service, including automated tools that access Douyin to collect its content, isn't allowed (clause 5.1).
  • Other users may forward, copy or download a user's content where the platform's features allow it (clause 10.5).
  • Users give the company a worldwide, free, non-exclusive license to their uploads, which can be sublicensed. That license goes to the company and doesn't extend to other users.
  • The company may monitor infringement and take action over content users upload, including demand letters and litigation.

The agreement doesn't expressly address saving a video for personal use, but it does address how content is obtained. Downloads through Douyin's own features are described as permitted where those features allow them. The agreement doesn't define "simulated download" or name specific tools, but a third-party downloader may fall within these restrictions, even for a clip you only keep privately. Reuse, redistribution and commercial use also appear to fall outside the personal, non-commercial license. The version we read was updated on February 13, 2026 and took effect on February 20, 2026. Terms change, so check the current version yourself.

How much does your use of the file matter?

It matters a lot. The table below shows some common situations and the main questions each one raises. It describes relative risk only, and it doesn't tell you whether a particular use is lawful.

What you doMain question to askRelative risk
Save a video you made yourselfDo you own everything in it, including the music?Lower

Does fair use cover Douyin videos?

Sometimes it might, in the US, but you can't assume it does. The US Copyright Office lists four factors from Section 107 of the Copyright Act:

  1. The purpose and character of the use, including whether it's commercial
  2. The nature of the copyrighted work
  3. The amount and substantiality of the portion used
  4. The effect of the use on the potential market for or value of the work

Courts weigh these factors together, based on the facts of each case, and they aren't a mathematical formula. No fixed number of seconds is automatically safe, and adding "no copyright infringement intended" to a caption doesn't settle the question.

The Copyright Office's Fair Use Index can show how courts have ruled in past cases, but it doesn't include every decision. Check its date too, since the Office's explainer page says its case search was last updated in May 2021.

Does the law change depending on where you live?

Yes. Fair use is part of US law, and other countries have their own rules and exceptions. Douyin is a Chinese service, but the laws that apply to you can depend on your location, the rights holder's location and where you publish the file. A use that's acceptable in one country may not be in another, so don't rely on a rule you read about somewhere else.

How can you lower your risk?

Before you save or reuse a clip, work through these questions:

  1. Is it yours? Your own videos are the simplest case, apart from any music you licensed from someone else.
  2. What will you do with it? Private reference and public reposting raise very different questions.
  3. Do you have permission? If not, ask the creator and keep the reply. Our guide to reusing Douyin clips with permission explains how.
  4. Does the music need separate clearance? Assume it might, especially for commercial use.
  5. Is the use important enough to need advice? For a business or a dispute, ask a lawyer.

Download.fan's download douyin video and download douyin mp3 pages both say to download only content you own or have permission to use, and to respect creators' copyright and Douyin's terms. A tool being free or easy to use tells you nothing about whether your use is lawful, and the responsibility for that remains yours.

Frequently asked questions

Is it okay to download a Douyin video for personal viewing?

There's no universal answer. Private use is generally a different situation from reposting, but it can still depend on local law. Douyin's terms also restrict unauthorized copying and downloading by improper means, which may include third-party tools. Saving through Douyin's own features, where available, or getting the creator's permission are the clearest routes.

Can I repost a Douyin video if I credit the creator?

Credit is good practice, but it doesn't replace permission. To repost someone else's clip, get the rights holder's permission unless a legal exception clearly applies to your situation. If you're unsure, don't repost it.

Can I use a song from a Douyin video?

Downloading a clip's audio doesn't give you the rights to the song. Music often has its own rights holders, so public or commercial use may need a license. Download.fan also notes that some sound is removed for copyright reasons.

Does removing a watermark make a video free to use?

No. A logo or creator ID has nothing to do with who owns the video, and the copyright stays with its owner either way. A file without a watermark still needs the same permission before you share it.
